Functions and role of the notary public

The public perceives two essential elements of the Notary Public’s role:

Trust

The first is TRUST, based on impartiality (all parties to the contract are protected), a high level of expertise in the legal and fiscal sector (following the most rigorous public exam ever) and the fact of being a public official (which makes him/her the guarantor of the truthfulness and legality of the deeds.

Efficiency

The second is the EFFICIENCY of a PRIVATE ORGANISATION: the Notary Public does not carry out his/her function as an employee of the State, but in a free professional organisation.

The speed with which documents are drawn up and all formalities completed, the ability to overcome technical difficulties in a short span of time, the electronic transmission of documents to the public registries are all made possible by considerable investment in human resources and IT tools, which guarantee security and efficiency for the citizen.

Taxation

Apart from inheritance, in which they are perhaps the greatest experts, Notaries Public are involved in two fundamental areas: the circulation of real estate assets (houses, offices, land, warehouses, essential assets for individuals and entrepreneurs) and the main stages of corporate activity.

In both cases, recourse to a Notary Public is required by law in order to ensure flawless agreements and that private autonomy does not exceed the limits of legality set by the legal rules.

Fairness for citizens

The Italian notariat was the first profession to take out an insurance policy covering all its members.

This means that when a citizen turns to a Notary Public, he or she can be sure that he or she will be fully protected, also in the event of an error.

The limited number of Notaries Public in the territory (whose number is limited because of the public function they perform and who, like judges, are tied to their place of assignment in order to guarantee assistance to the entire territory, including the most disadvantaged) is synonymous with quality, since Notaries Public enter the profession after extremely rigorous studies and are recognised as being among the most qualified legal professionals, having exceptional responsibility.

The number of women passing the exams – which are now held almost every year – is now equal to that of men and, significantly, only 18% of Italian Notaries Public have a family member operating in the same profession (the lowest percentage of all professions).
